EU, EEA or Swiss citizens, and their families, can apply to the EU Settlement Scheme to continue living in the UK after 30th June 2021.
But what if their application is refused?
That can happen because the applicant was not resident in the UK by 11.00 pm on 31st December 2020 or because they are considered unsuitable. Where an application is refused, the person can reapply up until 30th June 2021.
Your employee won’t automatically have the right to live and work in the UK after 30th June 2021. In this situation, they will need to apply for permission to work in the UK using an alternative immigration route. The Government says it will produce official guidance for employers closer to the scheme deadline.
